1. Agreement to Terms

Welcome to Digital Maven HQ. By accessing or using our website located at https://www.digitalmavenhq.com, purchasing any of our digital products, engaging our services, or enrolling in a maintenance subscription plan, you agree to be bound by these Terms and Conditions. Please read them carefully before making any purchase or using our services.

If you do not agree to these Terms, please do not use our website or purchase our products or services. These Terms apply to all visitors, users, customers, and others who access or use our website.

2. Products and Services

Digital Maven HQ offers the following products and services:

  • Service-based solutions
  • Website maintenance subscription plans

All digital product purchases grant you a non-exclusive, non-transferable license to use the product in accordance with the license terms outlined in Section 6 of these Terms.

3. User Accounts

To access certain features of our website, purchase products, or manage subscriptions, you may be required to create an account. By creating an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password confidential and not share it with third parties
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately if you suspect unauthorized access to your account

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms.

4. Payments and Subscriptions

4.1 General Payment Terms

All prices are listed in U.S. dollars. By making a purchase, you authorize us to charge your chosen payment method for the full purchase amount. We use secure third-party payment processors to handle all transactions. Digital Maven HQ does not store your full payment card information.

4.2 Monthly Maintenance Subscriptions

WordPress maintenance plans are billed on a recurring monthly basis. By enrolling in a subscription plan, you agree to the following:

  • Your payment method will be automatically charged each month on the billing date you established at sign-up
  • You may cancel your subscription at any time by contacting us or through your account dashboard
  • Cancellations take effect at the end of the current billing cycle; no partial-month refunds will be issued
  • We reserve the right to modify subscription pricing with at least 7 days’ written notice
  • Failure to maintain a valid payment method may result in suspension or termination of your subscription

4.3 Taxes

You are responsible for any applicable sales tax, use tax, or other government-imposed taxes or fees associated with your purchase. Where required by law, Digital Maven HQ will collect and remit applicable taxes.

5. Refund Policy

ALL SALES ARE FINAL. Due to the digital nature of our products/services and the immediate access granted upon purchase, Digital Maven HQ does not offer refunds, exchanges, or credits on any digital product/service purchases, including but not limited to:

  • Business templates
  • Marketing templates
  • Social media templates
  • Website templates
  • eBooks and digital guides
  • Service fees for work already performed

For subscription maintenance plans, you may cancel at any time to prevent future charges, but no refunds will be issued for the current billing period already paid.

If you experience a technical issue that prevents you from downloading or accessing a purchased product, please contact us within 3 days of purchase and we will work to resolve the issue.

6. Intellectual Property and License

6.1 Ownership

All digital products, content, designs, text, graphics, logos, and other materials available on Digital Maven HQ are the intellectual property of Digital Maven HQ or its licensors and are protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.

6.2 License Grant

Upon completing a purchase, Digital Maven HQ grants you a limited, non-exclusive, non-transferable, revocable license to use the purchased digital product/service for personal use or for use within a single business, subject to the following terms:

  • Each license is valid for personal use OR use within one (1) single business entity only
  • If you wish to use the same template for more than one business, you must purchase a separate license for each additional business
  • You may NOT resell, redistribute, sublicense, share, or give away the original template or product files in any form
  • You may NOT claim original authorship or represent our templates as your own creation
  • You may NOT use our products to create competing template products, template shops, or digital product bundles for resale
  • Templates may be used to create finalized deliverables (e.g., printed business cards, social media graphics) for yourself or your permitted single business, but the original editable template files may not be transferred to any third party
  • Website templates are licensed for use on a single website for one business; a new license must be purchased for each additional website or business
  • Purchasing a template on behalf of a client does not transfer the license to the client; the client must purchase their own license for independent use

6.3 User Content

If you submit any content to our website (such as reviews or testimonials), you grant Digital Maven HQ a royalty-free, worldwide license to use, display, and reproduce that content in connection with our business.

7. Prohibited Uses

You agree not to use our website or products for any of the following purposes:

  • Violating any applicable local, state, federal, or international laws or regulations
  • Infringing upon the intellectual property rights of Digital Maven HQ or any third party
  • Transmitting spam, malware, or other harmful or disruptive content
  • Attempting to gain unauthorized access to our systems or user accounts
  • Engaging in any conduct that restricts or inhibits any other user’s enjoyment of the website
  • Using our products in any manner that could damage the reputation of Digital Maven HQ

8. Disclaimer of Warranties

Digital Maven HQ does not warrant that our website will be uninterrupted or error-free, that defects will be corrected, or that our website or the servers that make it available are free of viruses or other harmful components. We do not guarantee that any specific results will be achieved from using our products or services.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL MAVEN HQ AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, OUR WEBSITE, PRODUCTS, OR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO DIGITAL MAVEN HQ IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
